1. Acceptance of Terms

By creating an account, accessing, or using the App, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must stop using the App immediately.

2. Modifications to Terms

We may update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App after any modifications indicates your acceptance of the updated Terms. We encourage you to review these Terms periodically.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App. By using the App, you represent that you meet these eligibility requirements.

4. User Accounts

To use the App, you are required to create an account using your Apple ID or Google account. By creating an account, you agree to:

• Provide accurate and complete information when creating your account
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately if you suspect any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

5. Subscriptions and Payments

FitMockup offers subscription plans to access premium features. By subscribing, you agree to the following:

• Subscription Fees: Subscription pricing and billing frequency are displayed at the time of purchase. All payments are processed through Apple's App Store.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.

6. License and Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for personal or commercial purposes (such as creating mockups for your business).

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Use the App for any unlawful purpose
• Sublicense, rent, or lease the App to third parties

7. User Content and Intellectual Property

Your Content: Any designs, images, or mockups you create using the App ("User Content") remain your property. You retain all rights to your original designs and artwork.

Our Content: The App, including its 3D models, interface, graphics, code, and all related materials, is owned by FitMockup and protected by intellectual property laws. You may not use our content outside of the App without permission.

Mockup Usage: Mockups you create using the App may be used for personal, commercial, or promotional purposes (e.g., displaying on your online store, social media, or client presentations).

8. Acceptable Use

You agree not to use the App to:

• Create, upload, or share content that is illegal, harmful, threatening, defamatory, or infringes on the rights of others
• Violate any applicable laws or regulations
• Interfere with or disrupt the App's functionality or servers
• Attempt to gain unauthorized access to the App or related systems
• Use the App to distribute malware or other harmful software
• Impersonate any person or entity

We reserve the right to remove content or terminate accounts that violate these guidelines.

9. Third-Party Services

The App may integrate with or rely on third-party services, including:

• AI enhancement services for image processing
• Authentication providers (Apple, Google)
• Payment processing through Apple's App Store

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions, content, or policies of third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use the App at your own risk.

11. Limitation of Liability

Within the bounds of applicable law, FitMockup shall not be held responsible for any indirect damages, including but not limited to lost revenue, lost data, or business interruption that may result from using the App.

Our maximum liability for any claim related to the App is limited to the subscription fees you have paid to us in the past twelve months.

12. Indemnification

You are responsible for your use of the App and any content you create. If your actions or content cause any legal issues or claims against FitMockup, you agree to cover any resulting costs, including legal expenses.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

You may stop using the App at any time by deleting it from your device. To delete your account, use the account deletion feature within the App or contact our support team.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitMockup operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels.
